CHRONOGRAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

These Terms are governed by and construed in accordance with the laws of Dallas, TX. Any legal action or proceeding arising under or with respect to these Terms shall be brought exclusively in the federal or state courts located in Dallas, TX.
